Terms and Conditions of Sale (TCS)

1. Preamble

These Terms and Conditions of Sale (TCS) govern all sales made through the PinkyBot website (https://PinkyBot.com), operated by PinkyBot SAS (hereinafter referred to as "We" or "PinkyBot"). They specify the rights and obligations of PinkyBot and its customers (hereinafter referred to as "Client(s)") in the context of the sale of automation and artificial intelligence services. Any order placed via the site implies full acceptance of these TCS without reservation.

2. Description of Services

PinkyBot offers automation services powered by artificial intelligence, including but not limited to:

Custom chatbot development;
Marketing campaign automation;
AI consultation for optimizing business processes.

The services offered are described as accurately as possible. However, variations may occur in the execution of the services depending on the Client's specific needs.

3. Prices

The prices of the services are indicated in euros (EUR), excluding taxes and inclusive of all taxes (VAT included). PinkyBot reserves the right to modify its prices at any time, but the services will be billed at the rate in effect at the time the order is confirmed by the Client.

3.1 Payment Methods:

Payment for services is made by credit card, bank transfer, or any other available and secure payment method offered at the time of the order. Invoices are issued after the order is confirmed and are payable upon receipt unless otherwise specified.

4. Order

Any order placed on the PinkyBot website constitutes a sales contract between the Client and PinkyBot. The Client agrees to provide accurate and complete information when placing the order. After the order is confirmed, the Client will receive a confirmation email.

PinkyBot reserves the right to refuse any order for legitimate reasons, particularly in the event of a prior dispute with the Client or the inability to perform the requested service.

5. Service Delivery Terms

PinkyBot’s services are provided online. Service execution times are specified at the time of the order but may be adjusted based on the specific requirements of the Client's project. PinkyBot commits to informing the Client of any changes regarding the deadlines.

6. Right of Withdrawal

In accordance with Articles L221-18 and following of the French Consumer Code, the Client has a period of 14 days from the order confirmation to exercise their right of withdrawal without having to provide any reasons or pay any penalties, except in cases where the service has commenced with their express consent before the end of the withdrawal period.

6.1 Exclusions from the right of withdrawal:

The right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period, with the prior agreement of the Client.

7. Client Obligations

The Client agrees to:

Provide accurate and up-to-date information necessary for the proper execution of the services;
Actively cooperate with PinkyBot to facilitate the smooth delivery of services, particularly by responding to requests and providing necessary documents.

In case of non-compliance with these obligations, PinkyBot reserves the right to suspend or cancel the service without entitling the Client to any refund.

8. Liability

PinkyBot commits to providing its services diligently and in accordance with industry standards. However, PinkyBot cannot be held liable in cases of force majeure or events beyond its control, such as IT failures or third-party service interruptions.

PinkyBot's liability is limited to direct and foreseeable damages resulting from the improper execution of the service and cannot exceed the total amount of the order.

9. Intellectual Property

All content (texts, images, graphics, logos, etc.) on the PinkyBot website or provided as part of the services are the exclusive property of PinkyBot or its partners and are protected by intellectual property laws. Any unauthorized reproduction or use of this content is strictly prohibited.

10. Confidentiality

PinkyBot and the Client agree to keep all information exchanged strictly confidential in the course of executing the services, except for information that is already public or must be disclosed by law.

11. Governing Law and Disputes

These TCS are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing an amicable agreement, the competent courts will be those within the jurisdiction of PinkyBot's registered office.

12. Modification of the TCS

PinkyBot reserves the right to modify these Terms and Conditions of Sale at any time. The applicable TCS are those in effect at the date of the Client’s order. Any changes will be communicated to the Clients via the website.
